In recent years, there has been a trend by credit card companies and debt buyers to file lawsuits against debtors for breach of credit card agreements, accounts stated, common law debt, and attorneys' fees, among other claims. When a credit card company opts to file suit in Texas, they must follow the Texas procedural rules that accompany that decision. They can no longer continue traditional debt collection practices and must proceed through a court of law. As plaintiffs, they must now prove their case by a preponderance of the evidence. This means they must produce admissible evidence that proves their case. In many instances, these plaintiffs are simply unable to meet this evidentiary burden.
In cases where the plaintiffs are able to meet this evidentiary burden, the plaintiffs are often willing to settle the matter for a significantly reduced amount.
Once served with a lawsuit from a credit card plaintiff, a defendant has a short time to assert its rights and hold the credit card company to the evidentiary burden required under the rules.
