CREDIT CARD DEBT LAWSUITS

Q:  How long do I have before my answer is due to the Court?
A:  The answer to this question depends on the Court where the plaintiff filed suit.  Regardless, the citation that was served with the petition should provide the date an answer or other responsive pleading is due for your case.  In justice of the peace courts, the answer will be due between 11 and 17 days from the date of service.  In a county court of law, the answer will be due between 21 and 27 days from the date you were served with the lawsuit.  

Q:  What can the plaintiff do if I do not file an answer?
A:  If a defendant fails to file an answer or other responsive pleading, the plaintiff can seek a default judgment from the Court.  If successful, the judgment can become final and the Plaintiff have all rights of a judgment creditor.  As a judgment creditor, the credit card company will have the ability to garnish funds in certain bank accounts, and cloud the title to certain property, among other things.

Q:  How much does it cost to hire an attorney to represent me in this case?
A:  This depends on the specific facts of your case.  Riney Palter typically offers a flat fee rate to handle these cases through trial, dismissal, and/or settlement.  The overall rate can be as low as $750.  A free case evaluation only takes a few minutes and we can provide an exact quote to handle your case at that time.

Q:  If I settle my case, do I have to pay the entire amount today?
A:  This depends on the specific plaintiff bringing the action.  However, some of the plaintiffs will work out a payment plan where the defendant can pay the settlement amount in twelve equal monthly installments with no interest.

Q:  Do cases ever settle for less than the amount claimed?
A:  Yes, cases are settled for significantly less than the amount claimed in the lawsuit. 

Q:  Are cases ever dismissed?
A:  Yes, in some cases, the plaintiff is simply unable to produce sufficient evidence to prove their case.  In these situations, we file appropriate documents to have the case dismissed.

Q:  Where do you practice?
A:  I practice law all over the state of Texas.  If you have been sued by a credit card company in any county in the Texas, I am admitted to practice in that court and am qualified to defend your rights in that case.
